Legal

1.1 Customer Age should be at-least 18 years for legal issues.
1.2 Jurisdiction in respect of any and all dispute arising out of or in relation to this agreement shall be exclusively the court to Tiruchirappalli, Tamilnadu-India Jurisdiction only.

Payment and Cancellation of Service

2.1 Project Advance must be above 70% of total cost(if the product cost is above US$.500 / INR 20,000). Below $500 worth project, the advance payment must be 100% of project cost.
2.2 Balance Payment should be paid at the time of Testing Period. Before going live it will be paid fully.
2.3 For Cloud Services (SaaS) The Service is billed in advance on a monthly basis and is non-refundable. There will be no refunds or credits for partial months of service, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.
2.4 Non-Payment Projects shall be deleted without any notifications. Maximum Duration of Late Payment is 10 days after completion. After payment shall add extra fine at 5% of pending amount.
2.5 Refund Policy: After signup for a product/service, the customer don’t have rights to claim for refund under any circumstances. There will be no refunds or credits for partial agreement terms. In order to treat everyone equally, no exceptions will be made.
2.6 For Recurring charges like domain, hosting renewal should be paid before 10 days from the expiry date. After due date you can’t claim for the particulars.

Agreement of Product/Service

3.1 The Agreement contains product/service specifications, features, schedules and other specific terms for the project requires. customer can’t request anything which is not specified in this agreement. In such cases the customer can request a new agreement with the his updated requirements.
3.2 Change in Agreement: The agreement constitutes the entire understanding of the SWOT and Customer. This agreement terminates and supersedes all prior understanding or agreements on the subject matter hereof. Any changes or modification thereto must be in writing and signed by both parties.
3.2 Require any features in future on existing application is possible with the additional estimated cost.

Usage & Responsibility of Service

4.1 You are responsible for the security of your passwords and for any use of your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify SWOT immediately.
4.2 SWOT has not responsible for any type of Virus, Hacking, Spam and other Vulnerabilities. In some premium services we take care of this things.
4.3 You may neither share nor re-sell your SWOT products to 3rd parties.
4.4 Your use of the Service must comply with all applicable laws, regulations and ordinances, including any laws regarding the export of data or software.
4.5 You agree not to engage in any activity that interferes with or disrupts the Service (or the servers and networks which are connected to the Service).
4.6 You acknowledge and agree that SWOT may restrict your API usage in order to preserve the quality of service for other users.

Licenses

6.1 Cloud Services holds SaaS(Software As A Service) Licensing Policy. In this manner we never share our source, ftp, domain & hosting control panel, api account logins.
6.2 Open Source Products holds Open Source Licensing that mean SWOT will provide the source to the customer. SWOT has not responsible for the product once its hands over to the customer.
6.3 We also deliver our service with Encrypted Source with customer acknowledgement.
6.4 For Customized Projects, we offer both Cloud/Developer to our customers. Developer Version costs calculated as=Estimated Product Cost X 3* (*3 can be vary as per project requirements).

Customer Support & Maintenance

7.1 We offer our support through our privileged Customer Support Ticket System
7.2 For Application Maintenance we charges annual charges as its quoted in estimate.

Modification and Termination of the Service

8.1 SWOT is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Service which SWOT provides may change from time to time without prior notice to you.
8.2 SWOT may introduce beta features. You acknowledge and agree that beta features may be substantially modified or removed from the Service without notice.
8.3 Deprecation policy. You acknowledge and agree that features may be deprecated and removed from the Service. Features shall generally be removed after a 6 month deprecation period, but SWOT may act faster or slower if justified, at its own discretion.
8.4 Feature removal. You acknowledge and agree that, in the event that a feature you are using is removed from the Service, SWOT has no responsibility to provide substitute functionality, a workaround, or any kind of compensation.
8.5 You may discontinue your use of the Service at any time. SWOT may, at any time, terminate your use of the Service if (A) you have breached any provision of the Terms (or have acted in manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms) or (B) SWOT is required to do so by law (for example, where the provision of the Service to you is, or becomes, unlawful). Further, SWOT may terminate your use of the Service for any reason with thirty (30) days prior written notice.
8.6 SWOT has the right to modify any terms, policies, prices from time to time at its sole discretion, without any notification to anybody
